TERMS AND CONDITIONS OF THE HYDROLIDER LOYALTY PROGRAMME
§ 1
GENERAL PROVISIONS
- These Regulations lay down the rules for the operation of the Hydrolider loyalty programme , organised by Agricola Hydraulika Siłowa Spółka z ograniczoną odpowiedzialnością, with its registered office in Lubień Kujawski, ul. 1 Maja 40A , 87-840 Lubień Kujawski, KRS 0001145563, NIP: 8883138450, REGON: 38196624000000, BDO: 000218310.
- The following terms used in these Terms and Conditions, capitalized unless the context indicates otherwise, shall have the following meaning:
- Loyalty Discount - granted to a Participant by virtue of his/her participation in the Programme under the terms of the Regulations
- Customer - an entity defined in § 1.3 and 1.4 of the Regulations, to whom the Programme is addressed
- Benefits - discounts and other benefits granted to the Participant by virtue of participation in the Programme on the terms set out in the Rules;
- Organiser or Hydrolider - Agricola Hydraulika Siłowa Spółka z ograniczoną odpowiedzialnością with its registered office in Lubień Kujawski, ul. 1 Maja 40A, 87-840 Lubień Kujawski, which operates the Hydrolider Loyalty Scheme on the territory of the Republic of Poland.
- Programme - Hydrolider Loyalty Programme, organised by Agricola Hydraulika Siłowa Spółka z ograniczoną odpowiedzialnością, addressed to the customers of the online shop www.Hydrolider.pl, who, by virtue of their participation in the Programme, will be entitled to Advantages on the basis of the Regulations.
- Rules - these Rules of the Hydrolider Loyalty Scheme
- Customer Service Point - a place, stationary shop in the Republic of Poland, where the Organiser has direct contact with a Customer or Participant
- Participant or Scheme Participant - an entity referred to in § 1.3 and 1.4 of the Rules, which has joined the Scheme.
- The Client and the Participant of the Programme may be a natural person who is a consumer (within the meaning of Article 221 of the Act of 23 April 1964 Civil Code, Journal of Laws of 2019, item 1145), with full legal capacity. A natural person conducting a business or professional activity in his/her own name, an organisational unit without legal personality which is granted legal capacity by the Act (including partnerships), legal persons.
- The Programme applies only to purchases of goods and services in the Hydrolider shop located on the website www.Hydrolider.pl.
- The rules and regulations of the Programme are available at the Customer Service Centre and on the website www.Hydrolider.pl.
- Participation in the Programme is voluntary and free of charge.
§ 2
RULES FOR JOINING THE PROGRAMME
- In order to join the Programme, it is necessary to register at the online shop www.Hydrolider.pl and to read these Rules.
- The customer can create an Account on the webshop in the following way:
- Directly after accessing the website and completing the electronic Registration Form, available under the "Register" tab.
- During the course of shopping, after placing the goods in the shopping cart, before making an electronic payment.
- In the Registration Form, the Customer voluntarily provides his/her personal data necessary for the correct creation of the Hydrolider Account and the implementation of the Programme. Completing the Registration Form, involves providing such data as: surname, first name, company details, telephone number, as well as mailing address.
- Registration of a Hydrolider Account requires reading the Regulations and indicating in the Registration Form that the Customer has read and accepts the content of the Regulations.
- The Account is valid for an indefinite period of time, calculated from the date of Account registration.
- The Participant is obliged to notify Hydrolider of any change in his/her personal data provided in the Registration Form by updating the data by logging into his/her Account on the website www.Hydrolider.pl in the "My Account" section.
- Hydrolider is not responsible for any delay or lack of operation of the Programme caused by the Participant's failure to update the data.
- The Participant guarantees the truthfulness of all information provided in the Registration Form and is the only person liable for any erroneous, inaccurate or outdated information.
- The Customer undertakes to create one Account in his/her own name. Programme points will be credited to the Account in which the purchases were made.
- The Hydrolider Account is personal and not transferable to another person, e.g. by assignment. The Participant is the person responsible for the Account and undertakes to use it in accordance with the terms and conditions set out in these Terms andConditions.
- The Program Participant is obliged to inform the Organizer of any type of unauthorized use of the Hydrolider Account.
- If the Participant fails to comply with these Rules, Hydrolider reserves the right to suspend the Programme, cancel any Benefits due to the Participant as well as deactivate the Account.
- The Organiser is not responsible for any kind of damage related to the Programme caused by force majeure and which would make it impossible to complete the Programme (e.g. weather disturbances, problems with network connection, etc.).
§ 3
BENEFITS ASSOCIATED WITH JOINING THE LOYALTY PROGRAMME
- Each Programme Participant who has created a Hydrolider Account is entitled to the following Benefits resulting from joining the Programme:
.- Award of Loyalty Points for the purchase of goods and services on the website www.hydrolider.pl, which are then exchanged for a Loyalty Discount, depending on the number of points accumulated.
- Unlimited return and exchange of goods purchased on the website www.hydrolider.pl.
- Receive information on promotional offers and on new products launched by Hydrolider, provided that the Participant has consented to this.
§ 4
RULES FOR CALCULATING LOYALTY POINTS
- Loyalty points are awarded to a Participant's Account for purchases of goods and services in the Hydrolider shop, made by the Participant or for and on behalf of the Participant by a person authorised by him/her.
- Loyalty points are awarded on the condition that purchases are finalised in the online shop by fulfilment of all terms and conditions of the purchase agreement.
- Loyalty points will be credited to the Account from which the purchase was made on the shop.
- Loyalty points are valid for 365 days from the moment they are collected.
- The Organiser awards 10 Loyalty Points for every 1 zloty spent (incomplete amounts will be rounded down) on purchases in the www.hydrolider.plonline shop.
- In the moment a Participant achieves a specified number of loyalty points, a discount is granted for subsequent purchases.
- The amount of the discount depends on the number of points earned:
- 10 points = 0.01 PLN discount
- 100 points = 0.10 PLN discount
- 1000 points = 1.00 PLN discount
- 10000 points = 10.00 discount
- (you can exchange any number of points for a discount, the system automatically converts the points into pln)
- A programme participant may at any time view the number of loyalty points he/she has collected by logging in to his/her personal Hydrolider account at www.hydrolider.pl.
- Loyalty points gained in the Programme have no commercial value and may not be transferred or transferred to other account holders on the website www.hydrolider.pl.
- Upon expiry of the Programme, a Participant's Loyalty Points are cancelled and will not be redeemable for Benefits.
- Loyalty points will not be credited for purchases of goods from the "promotions" section.
§ 5
CLOSING THE PARTICIPANT'S ACCOUNT AND WITHDRAWING FROM THE PROGRAMME
- A Participant's Hydrolider Account may be closed in the following situations:
- breach by the Participant of the terms and conditions of these Regulations
- the Participant's withdrawal from the Programme
- A Participant'sviolation of the terms and conditions of these Rules, in particular by incorrectly using the Hydrolider Account, providing false data or impersonating another person, may result in the Participant's exclusion from the Programme and the closure of his/her Hydrolider Account, which is equivalent to the Participant's loss of the right to the Benefits provided for in the Programme.
- The Program Participant may resign from the Program at any time, without stating a reason, by sending a resignation statement to Hydrolider at the Organiser's registered office or to the following email address: sklep@hydrolider.pl.
- A statement of resignation from the Programme should include information on the account holder's details and the e-mail address to which the Hydrolider Account was created.
- Resignation from the Programme results in the removal of the Participant's Hydrolider Account from the Programme system (as a consequence, the Participant will not be able to log in to his/her Account on the website www.Hydrolider.pl), cancellation of any accumulated Loyalty Points and non-receipt of Benefits for accumulated Loyalty Points, as well as deletion of the Participant's entire purchase history.

CHANGE OR TERMINATION OF THE PROGRAMME
- The Programme is valid for an indefinite period of time. The Organiser reserves the right to amend or terminate the Programme for important reasons, in particular due to technical and organisational changes.
- Any change to the Rules or termination of the Programme will not affect the rights and entitlements of the Participant acquired before the change or termination of the Programme.
- Any change to the Rules or termination of the Programme will be announced by the Organiser 30 days in advance in the shops at www.hydrolider.pl.
- The Participant of the Program will be informed of any changes to or termination of the Program by an electronic message sent to the e-mail address provided in the Registration Form.
- Loyalty Points collected by the Participant until the Programme's termination will be converted into Rewards according to the rules set out in the Rules.
- The Participant has the right to withdraw from the Programme in the event of a change to the Programme on the terms set out in these Rules.
§ 7
COMPLAINT PROCEDURE
- Complaints or information about irregularities concerning the Programme may be submitted as follows:
- in writing to the mailing address of the Organizer
- electronically to the electronic mail address: sklep@hydrolider.pl
- The complaint or information about irregularities should contain the name and surname of the Participant, as well as a detailed description and indication of the reasons for the complaint.
- The Organiser shall notify the Participant of the manner of considering the complaint or information about irregularities by registered letter sent to the address given in the complaint or information about irregularities, or by sending a message to the e-mail address (depending on the form of notification), within 30 days from the date of receiving the notification.
- The Organiser shall consider complaints or information about irregularities on the basis of these Regulations.
§ 8
PERSONAL DATA PROTECTION
- The administrator of personal data, i.e. the entity that decides for what purpose and in what way the Participant's personal data will be processed, is Agricola Hydraulika Siłowa Spółka z ograniczoną odpowiedzialnością with its registered office in Lubień Kujawski, ul. 1 Maja 40A, 87-840 Lubień Kujawski, KRS 0001145563, NIP: 8883138450, REGON: 38196624000000, BDO: 000218310.
- The Organiser processes personal data of the Participants of the Programme according to the principles specified in the rules of the online shop www.hydrolider.pl at: https://hydrolider.pl/en/content/11-terms-and-conditions
§ 9
FINAL PROVISIONS
- These Regulations and the rights and obligations arising from them are subject to the jurisdiction of Polish law.
- The rules of the Programme are set out exclusively in these Regulations and in mandatory provisions of law.
- These Regulations apply exclusively in the Republic of Poland.
- Any disputes arising from participation in the Programme will be resolved amicably, and if no agreement can be reached, the disputes will be subject to resolution by a court with jurisdiction over the Organiser's registered office.
- These Regulations shall be effective as of 1 June 2020.
